% 05.12.2018 Crl.M.A. 48959/2018 (waiver of costs) The learned senior counsel has explained the reasons as to why there was default in assistance on the last date, it being his preoccupation in urgent matter, and in this view the costs imposed by the said order are waived.

CRL.M.C. 3924/2016 and Crl.M.A.16450/2016, 48960-48961/2018 The learned senior counsel submits, on instructions, that the petitioner seeks permission to withdraw the petition and the applications filed therewith, reserving the contentions set out in the petition to be agitated as defences during the trial before the concerned criminal court. CRL.M.C. 3924/2016

The petition and the applications filed therewith are dismissed as withdrawn. The petitioner will have the liberty to take all such defences as are available in law including those based on the contentions in this petition. This also disposes of the pending applications. R.K.GAUBA, J.
