% 13.12.2017 Ms. Rekha Giri, Advocate had appeared for the petitioner in the morning and had sought time to take instructions in view of the fact that Writ Petition (Civil) No.728/2015, Arjun Gopal and Ors. Vs. Union of India & Ors., is pending in the Supreme Court. 2.

She subsequently appeared and stated that the Court may pass appropriate order in view of the aforesaid writ petition. 3.

In view of the directions given by the Supreme Court in Arjun Gopal (supra), we do not think that at this stage any direction or order in terms of the prayer made by the petitioner can be issued for grant of license to sell fire crackers. Counsel for the respondent states as on today, there is no license holder, who has been permitted to sell fire crackers under the Explosive Rules, 2008 in Delhi. 4.

In view of the aforesaid position, we are not inclined to examine the academic issue raised by the petitioner. However, in

case licenses are issued, it will be open to the petitioner to ask for revival of the present writ petition by moving an application. 5.

The writ petition would be treated as disposed of. SANJIV KHANNA, J.
