% 31.01.2018 After some hearing the counsel for the petitioner submits, on instructions, that he may be allowed to withdraw the present petition and the applications filed therewith and instead take all objections available to him in law by appropriate pleadings in the written statement, if so required, by moving an amendment application, and also to seek counter claim, of course, subject to law of limitation, in the nature of relief of declaration of his title qua the suit property.

The petition and the applications filed therewith are dismissed as withdrawn with liberty as prayed for granted. R.K.GAUBA, J.
