% 21.02.2019 IA No.16115/2018 u/S 151 CPC moved by plaintiff for seeking directions As per office note, affidavit not filed by the defendant and none is present on behalf of defendant to explain in this regard. Learned counsel for plaintiff submits that she has received a telephonic message from learned counsel for defendant that the affidavit dated 08.01.2019 sought to be filed on behalf of defendant, in terms of order of the Hon'ble Court dated 01.11.2018, has not been taken on record by the registry. It was the duty of the defendant to comply with the directions of the Hon'ble Court. The affidavits already on record are not as per the directions of the Hon'ble Court. Affidavits in terms of order dated 01.11.2018 be filed by the defendant within three weeks with advance copy to opposite side. The registry is also directed to take the fresh affidavit dated 08.01.2019 on record.
