O R D E R
% 27.08.2018 The parties have entered into a settlement agreement dated 27.07.2018 before the Delhi High Court Mediation and Conciliation Centre. The settlement agreement is signed by the authorised representatives of the plaintiff and the defendant and also the respective counsel. The learned mediator has also signed the settlement agreement. In terms of the settlement agreement, the defendant has to pay to the petitioner a sum of Rs.1,08,28,915/- in instalments.
The defendant undertakes to make necessary payments in terms of the settlement agreement. In case of delay in instalments on the part of the defendant, the plaintiff shall be entitled to simple interest @ 18% per annum. The terms and conditions of the settlement agreement are legal and valid.
Accordingly, a decree is passed in favour of the plaintiff and against the defendant in terms of para 7 of the settlement agreement. Binding the parties to the settlement agreement, the present suit is disposed of.
The plaintiff shall also be entitled to refund of the Court Fees under section 16 of the Court Fees Act, 1870.
