Appellant insurance company has filed an appeal for reduction of the award dated 10.08.2016 passed by the Learned MACT, awarding a compensation of Rs.24,30,274/- along with interest @ 9% p.a. from the date of filing of claim petition. On appeal, the insurance company deposited entire awarded amount with up to date interest in terms of the order dated 19.10.2016 passed by this Hon'ble Court to be deposited by means of cheque drawn in the name of UCO Bank A/c Ranvir Singh. 2.

After comprehensive discussions, it is agreed between the parties that out of the deposited amount along with the accrued interest, lump sum amount of Rs.1,50,000/- shall be refunded to the appellant insurance company and balance amount along with up to date total interest shall go to respondent(s)/Claimant (s). It is made clear that the recovery rights granted by the Ld. MACT shall remain undisturbed.

In view of the above, lump sum amount of Rs.1,50,000/- be directed to be released to the insurance company and the balance amount along with the accrued interest be released to the respondents(s)/claimants in terms of the award. Liberty is given to the respondent(s) to move tribunal for seeking pre-mature withdrawal of the said compensation and as and when the said application is moved, the tribunal may consider the same as per the law. 4.

The statutory amount of Rs.25,000/- with interest if any be refunded to the insurance company.
