% 14.07.2017 IA No.7680/2017 For the reasons stated in the application the delay in re-filing the present petition is condoned. Application is allowed. O.M.P. (E) (COMM.) 17/2017 This is a petition under section 27 of the Arbitration and Conciliation Act, 1996, praying for issuance of summons to the four named witnesses stated in the petition in terms of the order passed by the learned Arbitrator in the pending proceedings.

It has been prayed to summon Shri A.P.Kala, Mr.VijayPrakash, Shri K.S.Randhawa and Shri V.M.Son Kusare. The relevant details are given in the petition.

The learned Arbitrator by its order dated 20.5.2017 has allowed the petitioner to take the summons for the four witnesses. Despite advance notice none is present for the respondent. However, in view of the order of the learned Arbitrator dated 20.5.2017 the present petition is allowed.
