% 07.12.2017 CM No. 5143/2017 The issue of waiver of penalty of Rs.1,000/- per day as recorded in the order dated 06.05.2016 in the execution proceedings, though raised as a contention to seek relief from this Court in the C.M.(Main) No.1045/2016, was never pressed for adjudication nor even otherwise remotely decided or commented upon by this Court, while disposing of the said petition by order dated 18.10.2016. In this view, there is no question of any clarifications being given by this Court. The executing court may take a call and proceed in accordance with law on such issue.
