This is a joint application filed by the parties which is signed by the parties and supported by their affidavits. The application satisfies the requirements of Order 23 Rule 3 CPC.

The appeal is accordingly disposed of as compromised but no decree is passed.

As agreed by the parties the parties will remain bound by the terms of the settlement dated 21.8.2018 and in case of any disputes parties will be entitled to initiate appropriate independent proceedings to enforce their rights in terms of the Memorandum of Family Settlement dated 21.8.2018.

Whatever amount has been deposited by the appellant in this Court be returned back to the appellant along with accrued interest thereon.
