% 11.11.2016 CM APPL. 41893/2016 This is an application filed by petitioner/applicant seeking waiver of costs imposed upon him vide order dated 19.10.2016 passed by Indermeet Kaur, J. It may be noticed that while dismissing the writ petition on 19.10.2016, costs in the sum of Rs.10,000/- was imposed upon the petitioner. Mr.Sahoo, learned counsel for the petitioner, submits that this application is in fact an application seeking modification/review of the order dated 19.10.2016, passed by Indermeet Kaur, J.

This matter has been listed before this Court pursuant to the directions passed by Hon'ble the Chief Justice on 8.11.2016 that all matters pertaining to street hawkers and vendors be listed before this Bench. In our view, this application has been filed only to recall the order dated 19.10.2016 with respect to costs imposed and, thus, there was no requirement to list this matter before the Special Bench. Secondly propriety demands that an order seeking modification/review should be listed before the same Bench, especially when the Judge is still available.

Accordingly, list this application before Indermeeet Kaur J., on 18.11.2016, subject to and after obtaining Orders from Hon'ble the Chief Justice.
