During the course of hearing, learned counsel for the appellant states that the appeal be disposed of as not pressed but since the appellant and his predecessor-in-interest have incurred huge costs towards construction of the property, appellant be granted sufficient time to vacate the suit premises and which is being occupied since the last over 3 decades. 2.

Accordingly, while disposing of the appeal as not pressed, appellant is granted time to vacate the suit premises on or before 30.6.2020, subject to the appellant filing an affidavit of undertaking in this Court to vacate the suit property on or before 30.6.2020 and in which affidavit appellant must undertake to clear all dues towards local authorities whether

towards electricity charges, water charges etc., till the time the appellant stays in the suit property.

Subject to the appellant filing the aforesaid undertaking and complying with the terms of the same, appellant will not be evicted from the suit premises till 30.6.2020.

The appeal is accordingly disposed of as not pressed but granting time as stated above and subject to the filing of affidavit of undertaking and complying with the terms of the same. VALMIKI J. MEHTA, J JULY 17, 2017 ib
