% 11.01.2019 On 21st July, 2017, learned counsel for the respondent had entered appearance and prayed for and was accordingly granted three weeks' time to file the counter affidavit. The same has however, not been filed even after a lapse of almost one and a half years. Today, the representative of the respondent/DTC has appeared in person and prays for yet more time to file the counter affidavit. Though there is no justification for granting further time to the respondent for the said purpose, in the interest of justice, one last opportunity of six weeks is granted to the respondent to file the counter affidavit. It is made clear that in case the counter affidavit is not filed within the same period, the same shall be taken on record subject to payment of Rs.10,000/- as costs.
