CRL.M.C. 3852/2016 & CRL.M.A. 16173/2016 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.711/2014, under Sections 308/323/325/34 IPC, registered at P.S Model Town, Delhi.
Counsel for the petitioners has submitted that the incident had taken place on 7th October, 2014 resulting into registration of FIR No.711/2014, under Sections 308/325/323/34 IPC. Counsel for the petitioners further submitted that petitioner Nos.1 and 2 are real brothers of the complainant
and the respondent No.3. Counsel for the petitioners further submitted that after the incident with the help of near relatives, the matter is settled between the parties to upkeep better relations between the parties as they are real brothers and living in the adjacent houses. The complainant Mr.Charanjeet Singh and the injured Mr.Avtar Singh are present along with Investigating Officer SI Amit Rathee, Police Station - Model Town with Learned APP on behalf of the State. Complainant and the injured admit the settlement dated 3rd October, 2016 between the parties. The IO identifies the injured and the complainant and also confirms that the matter has been settled between the parties. Since the petitioner Nos. 1 and 2 and the complainant/respondent No.2 and injured/respondent No.3 are real brothers and residing in the nearby locality, to meet the ends of justice and to maintain better relationship between the brothers, FIR No.711/2014, under Sections 308/325/323/34 IPC, registered at Police Station-Model Town, Delhi and all the proceedings arising therefrom are quashed.
