% 24.10.2016 The petitioner is aggrieved by the fact that his plan seeking sanction of alteration of a stair case in property bearing No.C-16, Bhagwan Das Nagar, Rohtak Road, had been rejected; this had been rejected by the order dated 07.01.2016. Admittedly an appeal had been filed against this order which had been withdrawn by the petitioner on 10.05.2016. Before this Court what has been canvassed is that this appeal had been withdrawn for the reason that the stand of the Department was that the certain documents had not been filed by the petitioner along with his application dated 12.09.2013 which he has now rectified. This status report filed by the Corporation dated 05.04.2016 however notes another objection which was to the effect that in order to get sanctioned building plan, both the owners of the property had to apply as a one single unit.

Learned senior counsel for the petitioner submits that he will seeks revival of his appeal which he had withdraw on 10.05.2016 (before the ATMCD).

This petition is disposed of with liberty granted to the petitioner to move before the ATMCD. Learned senior counsel for the petitioner submits that he will be moving an appropriate application before the ATMCD within a period of one week from today. INDERMEET KAUR, J OCTOBER 24, 2016
