Petitioner impugns order dated 01.07.2016, whereby the eviction petition filed by the Respondents has been allowed and an eviction order passed.

Respondents had filed the subject eviction petition on the ground of bonafide necessity, under section 14(1)(e) of the Delhi Rent Control Act, 1958 seeking eviction of the Petitioner from one room situated at the First Floor of Property No. d-1, Gaffar Manzil
Extension - Part - II, Haji Colony, Okhla Delhi. 3.
Respondents are present in person in court today. 4.
Learned counsel for the parties submit that the parties have settled their disputes consequent to which respondents do not wish to pursue the eviction proceedings.

Learned counsel for the respondent submits that consequent to the settlement, respondents have withdrawn the execution petition filed consequent to the impugned order dated 01.07.2016. It is prayed that the eviction petition be dismissed as withdrawn. 6.
In view of the above, the impugned order dated 01.07.2016 is set aside. The eviction petition filed by the respondents is dismissed as withdrawn.

In view of the eviction petition having been dismissed, learned counsel for the petitioner seeks leave to withdraw the petition. 8.
Petition is accordingly dismissed as withdrawn. 9.
