Counsel for the parties confirm that the respondent company is in liquidation and that the Official Liquidator attached to this Court is in charge of its affairs.

To be noted, the petitioner is the original claimant. This petition had been filed for substitution of the Arbitrator as the incumbent arbitrator had indicated his inability to continue with the arbitration. 3.

Mr. Anoop Bagai, Senior Advocate, was appointed as an Arbitrator by this Court. Mr. Bagai has indicated via communication dated 9.8.2016 his inability to continue as the Arbitrator in the matter, albeit, due to personal reasons.

However, given the fact that a liquidator qua the respondent company has been appointed, counsel for the petitioner says that this petition can be closed with liberty to approach the liquidator for lodging a claim for payment of moneys which are presently the subject matter of arbitration proceedings.
