O R D E R

% 26.07.2017 The defendant no. 2 is personally present in Court and has been identified by learned counsel for the plaintiff. The defendant no. 2 states that he is the sole proprietor of defendant no. 1-Bajaj Plastics. He himself and on behalf of his son, i.e., defendant no. 3 states that he has no objection if the suit is decreed in accordance with the paragraph 32(a) of the plaint. Keeping in view the aforesaid statement, learned counsel for the plaintiff gives up relief for costs, damages, delivery up and rendition of accounts.

The statements made by learned counsel for the plaintiff as well as defendant no. 2 are accepted by this Court and all parties are held bound by the same.

Accordingly, present suit is decreed in terms of paragraph 32(a) of the plaint. Registry is directed to prepare a decree sheet. In view of aforesaid, present suit and pending applications stand disposed of.
