CM(M) 1056/2016 & C.M.No.38795/2016 After some arguments, learned counsel for petitioner states that he is not pressing the petition on merit. He is however seeking waiver of the cost. Cost of Rs.10,000/- was imposed upon the petitioner for not being able to cross-examine PW-1/respondent who had been examined-in-chief on 01.02.2016.

Learned counsel for petitioner points out that thereafter on

18.4.2016 PW-1 was partly cross-examined by the petitioner. On the next two following dates i.e. on 27.5.2016 and 28.7.2016 learned Presiding Officer was on leave and that is why the evidence could not be carried out. The next date is the date of the impugned order. Noting these facts as also keeping in view the fact that the petitioner has since left the job where she was employed, this Court is inclined to modify and reduce the cost. The cost of Rs.10,000/- is reduced to Rs.3000/-.

Petition disposed of.
