% 04.11.2016 We are informed by the learned counsel for the appellant that an Order 39 Rule 4 CPC application has already been moved, being IA 12042/2016 along with other applications. However, a long date has been given in the matter and it is now listed on 24.01.2017.

In view of the fact that the appellant is alleging concealment and suppression, it would be appropriate if the Order 39 Rule 4 application is heard on an early date.

Consequently, we direct that the said application be placed before the learned Single Judge on 18.11.2016, in the first instance, instead of 24.01.2017. The learned counsel for the appellant shall inform the learned counsel for the respondent about the change of the date in writing. The appeal stands disposed of.
