% 14.09.2018 C.M.37452/2018 (exemption) Exemption is allowed subject to just exceptions. Application stands disposed of.
C.M.37453/2018 (delay) This is an application filed by the appellant for condonation of delay in filing the present appeal.
For the reasons mentioned in the application, the delay of 96 days in filing the present appeal is condoned.
The application stands disposed of.
MAT.APP.(F.C.) 229/2018 & C.M.37451/2018 (stay) After some hearing in the matter, learned counsel for the appellant, on instructions, wishes to withdraw this appeal. However, the appellant seeks time to clear the arrears. The appellant, who is present in Court, submits that he would pay Rs.25,000/- within 10 days and balance amount of arrears will be
paid within five months. Since we have not issued notice in the matter, we do not deem it proper to modify the order of the Family Court or grant the concession so sought. However, we have no hesitation in saying that if such a request is made before the Family Court, the same would be considered favourably.
In view of the submissions made by the appellant, the appeal and C.M.37451/2018 are dismissed as withdrawn.
