W.P.(C) 9490/2018 & CM No. 36953/2018 (stay) The present petition under Article 226 of the Constitution of India, has been instituted by a school going student, praying as follows:- "a) The Respondent School be directed to defer the taking of examination of the Petitioner student. b) That the Respondent school be directed to ensure the provisions of extra classes of all subjects to the Petitioner as her non attending classes during the period of her ailment was beyond her control. W.P.(C) 9490/2018

c) The Department of Education be directed to ensure the Petitioner being student must not suffer in the hands of the Respondent school by denying her the justified reasonable relief of deferment of examination and provision of extra classes.

d) That the Any other and/or further relief which the Hon'ble Court deems fit and proper under the circumstances of the case may also be pleased." Learned counsel appearing on behalf of the respondent No. 1, has handed over in Court today, a copy of a communication dated 8th September, 2018, addressed to them, on behalf of the Gyan Devi Salwan Public School, respondent No. 2 herein.

A perusal of the said communication dated 8th September, 2018, reflects that, the respondent No. 2 School has acceded to, the petitioner's request to defer the taking of her examination on medical grounds, as well as, to impart extra classes to the petitioner, since she was unable to attend the regular classes, owing to her medical condition. In view of the forgoing communication, and since the relief prayed for, on her behalf, has been satisfied, learned counsel appearing on behalf of the petitioner does not press this petition, at this stage. The petition is dismissed as not pressed and disposed of accordingly. Pending application also stands disposed of.
