After some arguments, Mr. Dholakia seeks to withdraw the captioned petition. However, Mr. Dholakia says that the petitioner wishes to challenge the appointment of the Arbitrator. 2.

Accordingly, the petition is dismissed as withdrawn, as prayed for.

Insofar as, Mr. Dholakia's submission is concerned that the Petitioner would like to challenge the appointment of an Arbitrator, I am of the view that no liberty need be granted by me if such a remedy is available to the petitioner, in the given facts and circumstances, under the provisions of the Arbitration and Conciliation Act, 1996. 4.
