HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 20.10.2016 Crl. M.A. No. 16319/2016 (Exemption) Allowed, subject to all just exceptions.

CRL.M.C. 3881/2016 By the present petition the petitioner seeks cancellation of the bail granted to the respondent Nos. 3 and 5 by the learned Additional Sessions Judge vide order dated 6th September, 2016.

Despite repeated queries put to the learned counsel as to how the present petition impleading the respondent Nos. 4, 6 and 7 is maintainable as the prayer is for cancellation of bail granted to respondent Nos.3 and 5 only, learned counsel insists that since they were beneficiaries of the transaction they are also necessary parties. Unless and until bail is granted to the respondent Nos. 4, 6 and 7 no cancellation thereof can be sought.

The present petition is thus dismissed as misconceived. MUKTA GUPTA, J.
