The counsel for both the defendants i.e. Mr. Kastur Chauhan and M/s. Darji a partnership of Mr. Suresh Bhai M. Chauhan, Mr. Kastur Bhai Chauhan and Mr. Mahesh M. Chauhan states that the defendants are willing to suffer a decree for injunction as sought subject to the plaintiffs i.e Mr. Sunil Mittal and Darzi (India) LLP giving up their claim for damages. 2.

The counsel for the plaintiffs states that the plaintiffs are willing to so give up the claim for damages.

Accordingly, a decree is passed in favour of the plaintiffs namely Mr. Sunil Mittal and Darzi (India) LLP and against the defendants i.e. Mr. Kastur Chauhan and M/s. Darji (partnership of Mr. Suresh Bhai M. Chauhan, Mr. Kastur Bhai Chauhan and Mr. Mahesh M. Chauhan) in terms of prayer paragraph 34A (i) and (ii) of the plaint, leaving the parties to bear their own costs.

Decree sheet be prepared.
