It is the grievance of the petitioner that there is needless delay in disposing of the application filed by the petitioner under Order 39 Rule 10 CPC.

It is pointed out that the matter was fixed on 16.02.2016, 02.04.2016, 24.05.2016 and 23.08.2016 when the matter had been adjourned on the request of the respondents.

The learned counsel appearing for the petitioner vehemently argued that the order sheets dated 24.05.2016 and 23.08.2016 note that request of the respondent for adjournment was not opposed but this is factually incorrect and the petitioner has strongly opposed the adjournments on the said two dates.

Be that as it may, the matter is now fixed for argument on 28.10.2016. The trial court is requested to expeditiously dispose of the application on the said date or the subsequent date as per his convenience. No adjournment shall be granted to any of the parties while hearing the application under Order 39 Rule 10 CPC.

The petition stands disposed of.

A copy of this order be given dasti under the signature of the court master to the petitioner.
