% 21.10.2016 Crl. M.A. No. 16434/2016 (Exemption) Allowed, subject to all just exceptions.
CRL.M.C. 3920/2016 1.
By the present petition the petitioner seeks quashing of the FIR No. 937/2001 under Sections 498A/406/34 IPC registered at PS Rajouri Garden, New Delhi on the complaint of respondent No.2. 2.
Learned APP for the State points out that in the above noted FIR there are nine accused however, only one accused has come forward for quashing of the FIR.
3.
Learned counsel for the petitioner states that the respondent No.2 has only settled the matter with the petitioner.
4.
For an offence punishable with the aid of Section 34 or 120B or 109 IPC it would be improper to quash the FIR piecemeal qua one petitioner as CRL.M.C. 3920/2016
the same would have consequences during the trial. 5.
Consequently, the present petition is dismissed. MUKTA GUPTA, J.
