O R D E R

% 05.06.2017 Present petition is directed against the order dated 01.06.2017 passed by the Principal Judge (South), Family Court, Saket, by which the application filed by the mother (respondent herein) seeking custody of the minor child for six days has been allowed. It was pointed out by the learned Senior counsel appearing on behalf of the petitioner on the last date of hearing that copy of the order dated 01.06.2017 was made available.

Notice was issued in this matter on 02.06.2017 for today. A copy of the order has been handed over in Court. Respondent is also present in Court and represented by counsel. The matter was then taken up in the Chamber. The parties have agreed that the order of 01.06.2017 would be complied with. It is agreed by the respondent that during the entire period of six days, she would remain on leave to remain with the child. She has also informed the Court that

she is staying alone and she would request her parents, who are residents of Agra, to remain available. Both parties agreed that they would make every effort to make the child comfortable. It is also agreed that the respondent would visit the child after informing the petitioner during this period of six days. The respondent assures the Court that the petitioner would be made comfortable and would be welcomed. Both the parties agreed to make the stay of the child meaningful and enjoyable. Parties also agreed that for future visitation, as far as possible, they would arrive at a mutual agreeable schedule keeping in view that the routine of the child is not broken. The order of 01.06.2017 is modified in above terms and the child would be handed over to the mother on 06.06.2017 uptil 12.06.2017, as agreed.

It is made clear that the matter has not been heard on merits and the rights and contentions of both the parties are kept open. The petition is accordingly disposed of.
