The writ petitioner had inter alia challenged the certification granted to the movie "31st October" on its scheduled date of release i.e. 21st October, 2016. This relief was declined by the court on 21st October, 2016.

However, the matter was kept pending for consideration of the prayer at Sr.No.'B' that sought a direction to the respondents to enlarge the scope of the Appellate Tribunal constituted under Section 5D of the Cinematograph Act, 1952. There is no appearance on behalf of the petitioner. There was no appearance on behalf of the petitioner on the last date as well. W.P.(C) 9714/2016

We are informed by Ms.Shiva Lakshmi, CGSC appearing for the respondents that Section 6 of the Cinematograph Act, 1952 and Rule 32 of the Cinematograph Rules, 1983 have been struck down by a judgment of the Supreme Court reported at AIR 2000 SC 3678, UOI v. K.M. Shankarappa.

In view of the above, the parties have to abide by the above pronouncement of the Supreme Court and no furthers orders are called for in the present writ petition.
