O R D E R

% 04.10.2016 The case of the petitioner seeking allotment of an alternate plot had been rejected vide communication dated 21.07.2014. It had been noted that request letter sent by the department on 26.02.2014 asking to furnish all requisite documents had remained undelivered. The said documents had not been furnished by the petitioner. Contention of the Department is that earlier communication dated 26.02.2014 had informed the petitioner that the original copy of the General Power of Attorney (GPA) along with the details of the registration / stamping as per law has not been furnished. It is not the case of the Department that any other document was lacking qua the petitioner. It is also not the case of the Department that the copy of the GPA had not been

furnished. Their contention is that the original document has not been furnished.

Counsel for the petitioner submits that he will furnish the original GPA within a period of one week from today. The order dated 21.07.2014 is accordingly set aside. This is specially in view of the admitted position that earlier letter dated 26.02.2014 asking the petitioner to submit his original document remained undelivered. On the petitioner furnishing requisite documents before the Department the case of the petitioner shall be considered on merits as per seniority list.

Petition disposed of.
