% 07.06.2017 C.M. No.22265/2017 (Exemption) Exemption allowed, subject to all just exceptions. Application stands disposed of.

C.M. (M) No.651/2017 Challenge in this petition is to the order dated 29.05.2017 by which an application filed by the petitioner (mother) to take her son Master Sumer to the United States of America for evaluation and for more advanced treatment of autism was rejected.

After some hearing, learned counsel for the petitioner submits that the petitioner is not only aggrieved by the order by which the permission for advanced treatment has been declined, but also with the observations made by the Court which are without any basis. Ms.Banerji submits that various proceedings are pending between the parties and thus, in case the observations made by the Court are not set-aside, serious prejudice would be caused to the rights of the petitioner. The observation of the Court reads as under:- "...the apprehension of the respondent that the child may not come back to India cannot be brushed away."

Heard. After some hearing, the petition is dismissed as not pressed. However, it is made clear that the aforesaid observations will not come in the way of petitioner in any other proceedings between the parties. C.M. No.22264/2017 Application stands disposed of in view of the order passed in the main petition.
