IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 10500/2016 RAJ KUMARI ..... Petitioner Through: Mr. M.K. Bhardwaj an Ms. Shriambhra Kashyat, Advs.

versus BANK OF BARODA & ORS.

..... Respondents Through: Mr. Bhupendra Singh Chauhan, Adv. for R- 1, 2 & 3.

CORAM:

HON'BLE MR. JUSTICE NAJMI WAZIRI

O R D E R

% 07.11.2016 The petitioner claims retiral benefits pursuant to the demise of Mr. Mahavir Singh an erstwhile employee of the respondent bank who passed away on 20.01.2015. She claims to be the latter's widow. Her representations to the respondent bank did not yield any positive result on the ground that respondent no.4 i.e. Mrs. Sarita had already been nominated by late Mr. Mahavir Singh as his legitimate spouse. The respondent-bank has sought an appropriate declaration from the competent court regarding the petitioner's entitlement.

The petitioner is at liberty to pursue judicial remedies for production of decree/ order or such document which would prove her claim as the legal successor of Late Mr. Mahavir Singh. In view of the same, the learned counsel for the petitioner does not press the writ petition and seeks to withdraw the same with liberty to pursue his remedies as may be available in law.

Accordingly, the writ petition is dismissed as withdrawn. Liberty as prayed for is granted.
