O R D E R

% 27.07.2017 The Court entertained the present writ petition on 23.06.2017. The writ petitioner had sought directions for the postponement of the schedule for E-tender or quashing of the process for purchase of Diflubenzuron 25 % WP for polluted water or for appropriate direction to accept its bid. The Court had on 23.06.2017 required the respondent - EDMC to file affidavit.

Learned counsel for EDMC seeks liberty to place on record affidavit of the Municipal Health Officer. Liberty granted. The same is hereby taken on record.

The affidavit states that tender No. 15287 for procurement of Diflubenzuron 25% WP, processed for the use in 2017 - 2018 has

been cancelled on account of fact that it was against only a single bid. Apparently, the bid was also technically unfeasible. In view of this development, the Court is of the opinion that the claim in these proceedings is rendered infructuous. The writ petition is, therefore, dismissed as infructuous.

Pending application also stands disposed of.
