% 15.12.2016 By the present petition the petitioner seeks anticipatory bail in case FIR No.301/2016 under Sections 304B/498A/34 IPC registered at PS Jaitpur on the complaint of Sabir the brother of the deceased Rajida. In the complaint Mohd. Sabir the complainant alleged that his sister was married to Rahis Hasan S/o Mohd. Ali Hasan two and a half years ago. After the marriage Rahis Hasan and his family members started demanding dowry and tortured her. It is alleged that the father-in-law of the deceased demanded ₹50,000/- which were given by the father of the deceased. Even thereafter Rahis demanded a bullet motorcycle and the complainant Sabir gave a sum of ₹1,40,000/- to satisfy the same. Despite the demand of ₹50,000/- and ₹1,40,000/- having been met the husband, father-in-law and mother-in-law demanded ₹2 lakhs and pressurized the deceased to bring the BAIL APPLN. 2144/2016

It is further alleged that an earlier complaint was lodged against the in-laws at U.P. around 5-6 months ago wherein a settlement was arrived at and Rajida was brought back to her matrimonial home. However the in-laws continued to misbehave with her and beat her. Petitioner Rukhsar is the unmarried sister-in-law of the deceased. The allegations against the petitioner are that she along with the other brother and sister used to trouble the deceased and taunt her. It is also alleged that all the family members used to beat her. There is no specific allegation against the petitioner.

Considering the nature of allegations against the petitioner and the fact that she has already joined the investigation this Court deems it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest the petitioner be released on bail on her furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that she will join the investigation as and when directed and will not leave the country without the prior permission of the Court concerned.

Petition is disposed of. Order dasti.
