% 27.10.2016 This is a petition under Section 439 Cr.PC moved by the petitioner for grant of interim bail for a period of 15 days. Learned counsel for the petitioner has submitted that the wife of the petitioner is undergoing surgery on 8th November, 2016 in Maharishi Valmiki Hospital, Pooth Khurd, Delhi-110039.
Learned counsel for the petitioner has further submitted that petitioner be released on interim bail for a period of at least 15 days.
Learned APP for the State has filed the status report and vehemently opposed the bail application and pointed out that the petitioner is facing trial for the offences under Sections 406/419/420/467/468/471/34 IPC. Counsel
for the complainant is also vehemently opposed the bail application. At this stage, learned counsel for the petitioner has submitted that the date is already fixed for the operation of Gallbladder for multiple stones and at least he be permitted to see his wife in the police custody. Keeping in view the facts and circumstances of the case, the petitioner be taken to Maharishi Valmiki Hospital, Pooth Khurd, Delhi-110039 on 8th November, 2016 from 10.00 a.m. to 5.00 p.m in the police custody. The Superintendent, Tihar Jail to make the necessary arrangement. Copy of this order be sent to Superintendent, Tihar Jail for necessary compliance. The present interim bail application is disposed of accordingly. Copy of the order be given dasti.
