O R D E R

During the course of arguments, it is agreed that the appeal be disposed of by a consent order whereby all the disputes which are subject matter of the suit, the application letter, the allotment letter and the related documents, are referred to arbitration of an Arbitrator under the aegis of the Delhi High Court International Arbitration Centre.

Accordingly, I appoint Justice (Retd.) Anil Kumar as an Arbitrator to decide the disputes and differences between the parties as stated above. Parties agree to be bound by the rules and procedure of the Delhi High Court International Arbitration Centre. 3.

Parties to appear before the administrative authority/competent authority of the Delhi High Court International Arbitration Centre along with a copy of the present order on 9th May, 2017. FAO 504/2016

The competent authority of the Delhi High Court International Arbitration Centre and the Arbitrator appointed will act as per the rules and conclude the arbitration proceedings. 5.

This order is passed without prejudice to the respective rights and contentions of the parties with respect to the merits of the factual and legal disputes which have arisen between them. 6.

Since the suit is referred to arbitration in terms of Section 89 of the CPC, the respondent/plaintiff will be entitled to return of the court fee deposited in the suit and the Registry will accordingly issue the necessary certificate to the respondent/plaintiff. 7.
