O R D E R

% 15.05.2017 The petitioner seeks bail in anticipation of his arrest in connection with F.I.R. No.296/2016, instituted for the offence under Sections 498A/406 and 34 IPC at P.S. Ranjeet Nagar, It appears that the petitioner and the complainant, both, were earlier married and after obtaining divorce from their respective spouses, entered into matrimonial alliance with each other.

There appears to be some disputes between them with respect to running of the household.

The petitioner and the complainant, both, are gainfully employed.

The petitioner is an MBBS doctor whereas the complainant handles HR in a Firm.

The allegations in the First Information Report are not of such nature which would justify denial of the privilege of anticipatory bail.

The petitioner, under the orders of this Court, had joined investigation and even attempted for the settlement of the dispute.

The respondent/complainant also participated in the mediation proceedings but the mediation process remained non-starter and the efforts made by both the parties came a cropper.

The investigation is still continuing and the petitioner assures that he would participate in the investigation.

However, considering the nature of accusation and the developments which have taken place, this Court is persuaded to grant anticipatory bail to the petitioner.

In the event of arrest or surrender, the petitioner shall be released on bail on his furnishing a bond in the sum of Rs.15,000/- with one surety of the like amount to the satisfaction of the Arresting Officer. Needless to state that the petitioner shall keep on cooperating with the investigating agency. He shall furnish his telephone number and his present address to the Investigation Officer of this case and shall always keep his mobile telephone operational. In case the petitioner is found to be avoiding the investigation, it will be open to the State to apply for cancellation of the anticipatory bail.

The Bail Application stands disposed of.
