versus UNIVERSITY OF DELHI & ANR ..... Respondents Through:

CORAM:

HON'BLE MR. JUSTICE S. RAVINDRA BHAT HON'BLE MR. JUSTICE SUNIL GAUR

O R D E R

% 22.08.2017 The appellant's claim in the writ petition was that he should be given permission to appear in the V Semester LL.B. examination conducted by the Faculty of Law, Delhi University i.e. in one paper - Intellectual Property Law-II as a special case. It is pointed out that the impugned judgment overlooks the fact that the Delhi University had by special notification in 2013 granted one opportunity to those who could not clear all their exams in various faculties, within a maximum of 3 years after the last examination (or double the course period). It is submitted that the appellant's case ought to be treated as an exception and the direction sought should have been given. The Single Judge noticed the facts of the case and relied upon a decision of the Division Bench in LPA No.258/2016 (Awadesh Kumar v. LPA No.431/2017

Delhi University & Anr.) which had ruled that those who could not complete their LL.B. course in twice the permissible period i.e. a total of 6 years may not be afforded the opportunity of clearing their backlog exams. Having considered the record and the submissions, the Court is of the opinion that there is no infirmity in the impugned order of the learned Single Judge.

The appeal is therefore dismissed.
