Execution is sought of the order dated 9th August, 2010 of dismissal of a suit for specific performance imposing cost of Rs.50,000/- on the plaintiff and in favour of the defendant / execution petitioner. 2.

Admittedly, the value of the suit for the purposes of court fees and jurisdiction was less than the enhanced minimum pecuniary jurisdiction of this Court.

This execution filed in this Court inspite of Office Order dated 24th November, 2015 of Hon‟ble the Chief Justice in exercise of powers under Section 4 of the Delhi High Court (Amendment) Act, 2015 is misconceived and is rejected with liberty to the petitioner / decree-holder to approach the Court of appropriate pecuniary jurisdiction.
