% 18.01.2017 BAIL APPLN. 2208/2016 (1) The petitioner seeks anticipatory bail under Section 438 Cr. PC in case FIR No. 535/2016 under Sections 509/506/323/34 IPC registered at Police Station Neb Sarai. Status report is on record. (2) I have heard learned counsels for the parties and have examined the file. By an order dated 26.09.2016, the petitioner was granted interim protection and was directed to join the investigation as and when required. Status report reveals that the petitioner has joined the investigation thrice.

(3) The petitioner was not named in the FIR. His involvement emerged only when victim's statement under Section 164 Cr. PC was

recorded. Initially, the FIR was registered under Sections 323/506/509 IPC. Subsequently, Sections 354/354-A/354-B/342 IPC were added. (4) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.

(5) The bail application stands disposed of.
