After extensively hearing arguments in both the appeals, counsel for the appellant on instructions from the appellant who is present in person states that appeals be ordered to be disposed of as not pressed, and the appellant will vacate the suit premises and hand over actual, physical and vacant possession of the suit RFA 774-75/2018
premises to the respondent/landlord on or before 15.12.2018. Also, the appellant will clear all arrears of the money decree in terms of the impugned judgment which is the subject matter of RFA 774/2018 on or before 15.12.2018 in three equal instalments, with one instalment payable every month commencing from the 15th of that month to the 15th of the next calendar month. Appellant will also clear all charges towards electricity, water, etc. till the time appellant stays in the suit premises and paid bills every month will be handed over to the respondent/landlord-Sh. Sushil Kumar.

Let the appellant file an affidavit of undertaking in this Court in terms of the present order within one week and on the appellant filing the affidavit of undertaking and complying with the terms of the same these appeals are disposed of as not pressed, but appellant is granted time to vacate the suit premises on or before 15.12.2018. 3.
The appeals are disposed of accordingly.
