WP(C) 5252/2017 & CM APPL. 22297/2017 (STAY) Challenge in this writ petition is to the order dated 9.5.2017 by which the name of the petitioner has been ordered to be removed from the State Medical Register for a period of 30 days.
Notice. Learned counsel for the respondents accept notice. Learned counsel for respondent no.1 submits that the present writ petition can be disposed of as the appeal filed by the petitioner is yet to be listed on account of a defect in the appeal and till the appeal is decided respondent no.1 shall not give effect to the order dated 9.5.2017. Counsel for respondent no.1
further submits that the defect in the appeal as pointed out in the letter dated 6.6.2017 should be rectified within a period of one week from today. Learned senior counsel for the petitioner submits that the defect would be rectified within a period of one week.
In view of the stand taken by counsel for respondent no.1 that till the appeal is decided, the order dated 9.5.2017 would not be given effect, the present writ petition and application stand disposed of binding the respondent no.1 to the statement made by the counsel in Court. Rights and contentions of all the parties are kept open.
