The present petition is filed under Article 226 of the Constitution seeking directions to the respondent with the following prayers:- a) issue a writ in the nature of prohibition, prohibiting the respondent from taking any action / carry out demolition in the properties being house nos. H-251A, H-225, H-219B, & H-228 situated in the Block H, falls in khasra no. 871 now changed to khasra no. 1928, situated in the revenue estate of Village Aya Nagar, New Delhi without following the due process of law; b) issue a writ in the nature of prohibition, prohibiting the respondent from dispossessing the Petitioners from properties being house nos. H-251A, H-225, H-219B, & H-228, situated in the Block H, falls in khasra no. 870 now changed to khasra no. 1928, situated in the revenue estate of Village Aya Nagar, New Delhi without following the due process of law;

respondent to carry out the demarcation and demarcate the property and supply the copy of the notice/proceedings/order if any for demolition/vacation of the property to the petitioners; d) Such further or other orders as may be deem fit and proper in the present facts and circumstances of the case. 2.

The counsel for the petitioners stated that the properties/houses, subject matter of the present petition have now been vested with the MCD as the village has already been ordered to be urbanised and seeks permission to withdraw the present petition with liberty to initiate appropriate legal proceedings if need arises.

Accordingly, the present petition along with pending application, stands dismissed as withdrawn with liberty as prayed for. DR.
