After some arguments, learned counsel for the petitioner seeks to withdraw the captioned petition and file, if necessary, a fresh petition with the relevant documents on record. 2.

I may indicate that the respondents have raised a preliminary objection that the Proprietor of Chakradhar Industries is not Mr. Nand Nandan Sureka.

2.1 For this purpose, learned counsel for the respondents has referred to some documents which were placed on record by the petitioner.

Mr. Mathur, who, appears for the petitioner, says that the proprietorship concern has changed hands and hence, Mr. Nand

Nandan Sureka, who is the brother of Ms. Manjari Sureka has taken over the aforementioned proprietorship concern. 4.

To be noted, none of the documents placed on record demonstrate what is portrayed before me by Mr. Mathur. 5.

The petition is dismissed as withdrawn with liberty to approach with relevant pleadings and documents.

If a fresh petition is filed, this aspect of the matter will be examined.
