% 03.01.2018 Present suit has been filed as an indigent person seeking decree of declaration, permanent injunction, rendition of accounts and damages.
On 19th July, 2017, the present suit was referred to the Delhi High Court Mediation and Conciliation Centre. Mediation in the present case has been successful through the efforts of Mr.Sharanjit Singh Wadhwa, Advocate-Mediator. A Settlement Agreement has been executed between the parties on 22nd December, 2017. In view of the aforesaid settlement, learned counsel for defendant nos.1 to 6 and 7 to 10 has handed over to learned counsel for the plaintiff an account payee cheque dated 23rd November, 2017
drawn on Deutsche Bank, Kasturba Gandhi Marg, New Delhi for Rs.27 lakhs in full and final settlement.
Learned counsel for the plaintiff states that upon encashment of the said cheque, the plaintiff shall be left with no claims and demands against the defendants and all disputes and differences between the parties stand settled through the process of mediation. Consequently, learned counsel for the plaintiff wishes to withdraw the present suit. Accordingly, the present suit is dismissed as withdrawn. MANMOHAN, J JANUARY 03, 2018 KA
