At the outset learned counsel for the petitioner states that though he does not press the present petition with liberty to file an application for bail before the learned Trial Court however, his grievance is the delay in trial. 2.

FIR No.18/2009 under Section 376 IPC was registered at PS Lodhi Colony on 1st February, 2009 and since then the petitioner has been in custody. Prosecution has cited as many as 11 witnesses who have all been examined. Considerable delay in the trial took place because the Investigating Officer was on long leave.

Learned APP for the State submits that since supplementary charge sheet has been filed the prosecution would examine two more witnesses. 4.

Considering the fact that the trial is pending for the last more than eight years, the Trial Court is directed to expedite the trial and conclude the BAIL APPLN. 2176/2016

same preferably within four months.

Petition is disposed of with liberty to the petitioner to revive the bail application before the learned Trial Court, if so advised. MUKTA GUPTA, J.
