versus STATE ..... Respondent Through : Mr. Sanjay Lao, ASC
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 24.10.2016 Crl. M.A. No.
/2016 (exemption) {to be numbered} Allowed, subject to all just exceptions. Application is disposed of. W.P.(CRL) 3070/2016 Petitioner seeks parole on the ground of filing the Special Leave Petition. He is in custody for about 12 years. However, in view of the post conduct of the petitioner, in my opinion, it would not be safe to release him on parole. Petitioner has already been convicted in two cases arising from FIR Nos. 222/2012 under Section 324 IPC and 122/2007 under Sections 307/323/326 IPC. Both these cases were registered after the present case, that is, FIR No. 83/2005 under Section 302 IPC, P.S. Mangolpuri. Two
cases, being FIR No. 526/2015 under Sections 147/148/149/302/34 IPC and FIR No.
306/2013 under Sections 147/149/323/324/304/120-B IPC registered at Police Station Hari Nagar, are still pending against him. In fact, as per the FIR No. 526/2015 petitioner has murdered co-inmate Ravinder @ Arjun in Jail No. 1, on 8th April, 2015. Petition is dismissed.
