% 18.01.2018 I.A. No. 828/2018 (under Order 23 Rule 3 CPC, filed by plaintiff and defendant nos. 1 and 2) 1.

This is an application under Order 23 Rule 3 CPC filed by the plaintiff and defendant nos. 1 and 2 whereby it is stated that these parties have settled their disputes in terms of Strategic Cooperation Agreement dated 30.12.2017 and it is stated that parties will be bound by the terms as stated in this Strategic Cooperation Agreement dated 30.12.2017.

Accordingly, though no decree can be passed or is passed with CS(COMM) 1425/2016

respect to the Strategic Cooperation Agreement dated 30.12.2017, but parties have agreed and accordingly would be bound by the terms of the Strategic Cooperation Agreement dated 30.12.2017. 3.

Learned senior counsel for the plaintiff states that the suit is not pressed as regards the other defendants.

In terms of the prayer made in this application whatever are the bank guarantees which have been given by the defendant no. 2 in favour of the Registrar General of this Court shall stand discharged and the Registry of this Court will release these bank guarantees to the defendant no. 2.

The suit is accordingly disposed of in terms of the aforesaid observations.
