2.1 Mr. Himanshu Tyagi accepts notice on behalf of the respondent. Learned counsel says that he does not wish to file a reply and that he will argue on the basis of the record. It is not disputed by the learned counsel for the respondent that in a suit filed by the petitioner, initially in this Court, which due to pecuniary jurisdiction stood transferred to the District Court at Karkardooma, a petition under Section 8 of the Arbitration and Conciliation Act, 1996 (in short '1996 Act') was preferred by the respondent. Learned counsel says that the said petition has been allowed.

Given these circumstances, learned counsel for the respondent says that he would have no objection if this Court were to appoint an Arbitrator. Learned counsel for the petitioner submits likewise. Accordingly, Mr. Krishan Kaushik, former District & Sessions Judge, Delhi (M: 9599499060) is appointed as an Arbitrator. Learned Arbitrator will be paid fee as per the Fee Schedule incorporated in the Fourth Schedule appended to the 1996 Act.
The petition is disposed of in the aforesaid terms. Dasti.
