% 04.01.2017 Learned counsel for the applicant-respondent no.5 states that vide order dated 17th November, 2016, the District & Sessions Judge in MCD Appeal No.4/2016 filed by the applicant against the order of the Appellate Tribunal MCD has stayed the demolition of the property in question. He further states that the stay order is in operation and the matter is listed for hearing on 13th February, 2017. Issue notice to the non-applicants.

Mr.Ankit Jain, learned counsel accepts notice on behalf of the petitioner.

Keeping in view the fact that the District & Sessions Judge in MCD Appeal No.4/2016 has stayed the demolition of the property in

question, the present contempt petition is disposed of as infructuous and the direction issued by this Court on 16th December, 2016 is recalled.

In the event, the appeal filed by the applicant-respondent no.5 is dismissed or the interim stay is vacated, petitioner is given liberty to file appropriate proceedings in accordance with law. Order dasti.

The next date of hearing stands cancelled.
