By this petition, the petitioner seeks bail in case FIR No.344/2017 under Section 307 IPC registered at PS Ranhola. The abovenoted FIR was registered after a PCR call was received at PS Ranhola vide DD No.41A. On reaching the spot, no eye witness was available and the complainant Mukesh was found unfit for statement. Mukesh was shifted to Nursing Home and his injuries were opined to be grievous in nature. 2.

Later statement of Mukesh was recorded wherein he took the name of the petitioner as the assailant. Pursuant to the statement of the complainant, petitioner was arrested and the weapon of offence was recovered. The alleged action ensued because the petitioner had retained the mobile phone of the injured and on his asking back the mobile phone, petitioner cut the throat of the injured.

Considering the nature of injury which is a deep incised wound in the left side chest wall along with left arm and the fact that the victim in his statement before Court has supported the case of the prosecution, this Court finds no ground to grant bail to the petitioner at this stage. 4.

Petition is dismissed.
